The Probate process involves two distinct phases, which should not be confused.


To clarify:


  • Obtaining the Grant of Probate: This is just the initial step in the broader, more extensive Probate process. Obtaining the Grant of Probate can take anywhere between 2 to 12 weeks, depending on the Probate Office's workload and how quickly they can review and process the application.


  • The Entire Probate Process: After you receive the Grant of Probate, you should plan for the entire Probate process, which involves executing the Will, valuing and liquidating the assets, settling debts, paying inheritance tax (IHT) and distributing the Estate. The entire process will depend on the value and complexity of the Estate and how efficiently the probate process is handled. Generally, you should expect anywhere between 12 weeks and two years.


Please note that these are general estimates. Timescales can vary based on individual circumstances, the complexity and value of the Estate, and any unforeseen occurrences.
